Sir Keir Starmer and Angela Renner have received a questionnaire from Durham Constabulary on possible violations of lockdown rules.
The force is probing a gathering in party offices in April last year in which The labor leader was pictured drinking beer and eating curry.
If he is fined by the police for eating and drinking, Sir Keir has promised to resign.
The incident occurred at Durham Miners Hall during a day of campaigning for the Hartlepool by-election.
Labor insisted that the gathering was a legitimate business meeting and was permitted under the law at the time.
But Sir Keir said that if the authorities drew a different conclusion, he would ‘do the right thing and step down’ as a ‘matter of principle and honour’.
